Why these returns need planning
Trusts hit the top tax bracket fast.
Trusts and estates reach the top federal bracket at a far lower income level than an individual does. Whether income is taxed to the trust or carried out to beneficiaries on a K-1 can change the total tax bill significantly.
- Distribution timingWhen income leaves the trust decides who pays tax on it.
- Fiscal year for an estateAn estate can choose its year end, which can defer income.
- Capital gainsHow gains are treated is settled before the return is filed.

Common questions
Before you book.
Does every estate have to file Form 1041?
No. A federal return is required when the estate has gross income of $600 or more for the year, or has a beneficiary who is a nonresident alien.
Is Form 1041 the same as an estate tax return?
No. Form 1041 reports income earned by the estate or trust. The federal estate tax return is Form 706, and New Jersey's tax on inheritances is reported on Form IT-R.
Do beneficiaries pay tax on what they receive?
Beneficiaries are taxed on the income reported on their K-1, not on the inheritance itself for federal purposes. New Jersey Inheritance Tax is a separate question.
